Title: Separation of Powers
Post by: StinkyPete on December 26, 2020, 05:53:01 AM
I am appaled to read that President Trump is hard at work issuing pardons for his mates who have been convicted of a range of offences, before he leaves office.   See  https://www.news.com.au/world/north-america/us-politics/donald-trump-pardons-roger-stone-charles-kushner-and-paul-manafort/news-story/6067784d5f8905d3c97dddab2d1889a0 (https://www.news.com.au/world/north-america/us-politics/donald-trump-pardons-roger-stone-charles-kushner-and-paul-manafort/news-story/6067784d5f8905d3c97dddab2d1889a0)

Thanks goodness that this kind of action shouldn't occur here in Oz, where we have "Separation of Powers" enshrined in the constitution, whereby Parliament, Executive and Judiciary are independant and cannot interfere with each other's roles.    Those unfamiliar with the concept of "Separation of Powers" can read about it here.    https://peo.gov.au/understand-our-parliament/how-parliament-works/system-of-government/separation-of-powers/ (https://peo.gov.au/understand-our-parliament/how-parliament-works/system-of-government/separation-of-powers/)

I am equally appalled at the pardons, but pleased to note that there are plenty of legal people (including former fwderal prosecutors) who are investigating how the pardons can be legally challenged.

Our three branches of government are not truly separate because, unlike the USA, our heads of the Executive branches come from the Legislative Branch.

And like all good tree branches they have a habit of dropping off.

It's not a good look for democracy, sadly, and it could get worse:

January 6 2021 seems to be the critical day. I trust good men (& women) prevail.

John Stuart Mill said in 1867: “Bad men need nothing more to compass their ends, than that good men should look on and do nothing.”
