Title: Victorian Lane Filtering - LAW
Post by: Sim on September 29, 2015, 06:01:24 PM
Hip Hoorah, saw on the news tonight that Victoria is about to introduce a legislative change to allow lane filtering. As from Nov 2 2015. Hoorah, what a big thing for the motorcycling community in that State instead of doing it anyway - illegally). Maybe other States can follow common sense.

Wouldn't thought you would need to filter in Portland, except when it gets busy between 5:00pm and 5:05pm on Fridays.

Hi All,

North of the border, Qld has had this law in since February 2015.
You are restricted from traffic stopped up to 35KPH then you have to fall back into line, so to speak.

Actually it is traffic 30 km/h and below and you can only do up to 30 km/h as well. Fine is $341 + 3 points :law

The Andrews Labor Government is delivering on its commitment to change laws to allow motorcycles and scooters to lane filter.

Following consultation with motorcyclists, cyclists and drivers, the changes to the current road rules will come into effect on 2 November 2015.

Lane filtering is the practice of motorcycles and scooters travelling at low speed through stopped or slow moving traffic, for example at traffic lights.

While not explicitly banned, riders who filter are at risk of committing an offence under a number of Victorian Road Safety Road Rules.

The changes affect a wide range of community members, not just motorcyclists, and it is important that all road users are aware of the new laws.

The Government has extensively sought people’s opinion on the changes, with a community meeting in June and over 1,000 online survey responses.

The new lane filtering measures do not permit lane splitting, which is when motorcycles travel between moving traffic at high speed. This is currently unlawful and will remain so because of the danger it poses to all road users.

The new regulations do not change how motorcyclists interact with special purpose lanes, such as bike lanes, bike boxes and tram lanes.

The changes include permitted filtering:

between lanes or lines of traffic in the same direction
between lanes or lines of traffic and parked cars
for motorcycle licence holders (not learner permit holders)
at speeds up to 30km/h (penalties will apply for filtering in excess of 30km/h)
unless signed otherwise.
VicRoads will support the law change with a public awareness campaign for all road users.

More detailed information on the new filtering measures can be found at www.vicroads.vic.gov.au (http://www.vicroads.vic.gov.au)

Silly question inbound

Does lane filtering mean I can access the emergency lane or must I travel between the cars?

In Qld;
Rules for riding on road shoulders

If you hold an open licence for the motorcycle you are riding, you can ride on road shoulders and in emergency stopping lanes on major roads—such as highways, freeways and motorways past stationary or slow moving traffic if:

the speed limit is 90km/h or more
your speed is 30km/h or less
you give way to cyclists or other motorcycle riders already using the shoulder.

Road shoulders are the sealed area to the left or right of a road's edge line.

Part of the Lane filtering laws:
To ensure pedestrian safety, lane filtering is only allowed between stationary or slow moving vehicles, not between a vehicle and the kerb. Any vehicle, including a motorcycle may overtake to the left of a stationary vehicle.

You are right. If the establishment catch you between a car and the kerb you better have plenty of money unless you are in your own lane and turning left or the very least in a marked lane. You are also as an earlier post states not allowed to use the pushbike marked lane.

In QLD you are allowed to use the "green box" (painted area for bicycles at lights) giving way to bicycles of course.

and, you may enter the bicycle lane up to 50 metres before the "bicycle storage area", as they call that green box.
