Some Interesting Qld Road Rules and By-laws...

A discussion I have been having prompted me to cut n paste some of the Qld legislation regarding the use of vehicle and the road in this state. Might clear up so myths, and might change the way you go about business.

RADAR DETECTORS...

225 Using radar detectors and similar devices

(1) A person must not drive a vehicle if the vehicle, or a trailer being towed by the vehicle, has in or on it—
     (a) a device for preventing the effective use of a speed measuring device; or
     (b) a device for detecting the use of a speed measuring device.

Maximum penalty—40 penalty units.

(2) A person who is travelling in or on a vehicle or trailer must not have in the person’s possession a device for preventing the effective use of a speed measuring device, or a device for detecting the use of a speed measuring device.
Maximum penalty—40 penalty units.

(3) Subsections (1) and (2) apply whether or not the device is operating or in working order

OVERTAKING....


Division 3 Overtaking
140 No overtaking unless safe to do so
A driver must not overtake a vehicle unless—
    (a) the driver has a clear view of any approaching traffic;
and
    (b) the driver can safely overtake the vehicle.
Maximum penalty—20 penalty units.

141 No overtaking etc. to the left of a vehicle
(1) A driver (except the rider of a bicycle) must not overtake a
vehicle to the left of the vehicle unless—
    (a) the driver is driving on a multi-lane road and the vehicle
can be safely overtaken in a marked lane to the left of
the vehicle; or
    (b) the vehicle is turning right, or making a U-turn from the
centre of the road, and is giving a right change of
direction signal and it is safe to overtake to the left of the
vehicle; or
    (c) the vehicle is stationary and can be safely overtaken to
the left of the vehicle.
Maximum penalty—20 penalty units.
(2) The rider of a bicycle must not ride past, or overtake, to the
left of a vehicle that is turning left and is giving a left change
of direction signal.
Maximum penalty—20 penalty units.
(3) In this section—
turning right does not include making a hook turn.
vehicle does not include a tram,  a bus travelling along tram
tracks, or any vehicle displaying a do not overtake turning
vehicle sign.

142 No overtaking to the right of a vehicle turning right etc.
(1) A driver must not overtake to the right of a vehicle if the
vehicle is—
    (a) turning right or making a U-turn from the centre of the
road; and
    (b) giving a right change of direction signal.
Maximum penalty—20 penalty units.

(2) In this section—
turning right does not include making a hook turn.
vehicle does not include a tram,  a bus travelling along tram
tracks, or any vehicle displaying a do not overtake turning
vehicle sign.

CHANGING LANES - WHO HAS RIGHT OF WAY?....

148 Giving way when moving from 1 marked lane or line of
traffic to another marked lane or line of traffic

(1) A driver who is moving from 1 marked lane (whether or not
the lane is ending) to another marked lane must give way to
any vehicle travelling in the same direction as the driver in the
marked lane to which the driver is moving.
Maximum penalty—20 penalty units.

149 Giving way when lines of traffic merge into a single line
of traffic
A driver in a line of traffic that is merging with 1 or more lines
of traffic travelling in the same direction as the driver must
give way to a vehicle in another line of traffic if any part of the
vehicle is ahead of the driver’s vehicle.
Maximum penalty—20 penalty units

MOTORBIKES SHARING LANES....

151 Riding a motorbike or bicycle alongside more than 1 other rider

(1) The rider of a motorbike or bicycle must not ride on a road
that is not a multi-lane road alongside more than 1 other rider,
unless subsection (3) applies to the rider.
Maximum penalty—20 penalty units.

(2) The rider of a motorbike or bicycle must not ride in a marked
lane alongside more than 1 other rider in the marked lane,
unless subsection (3) applies to the rider.
Maximum penalty—20 penalty units.

(3) The rider of a motorbike or bicycle may ride alongside more
than 1 other rider if the rider is overtaking the other riders.

(4) If the rider of a motorbike or bicycle is riding on a road that is
not a multi-lane road alongside another rider, or in a marked
lane alongside another rider in the marked lane, the rider must
ride not over 1.5m from the other rider.
Maximum penalty—20 penalty units.

(5) In this section—
road does not include a road-related area, but includes a
bicycle path, a shared path and any shoulder of the road.

The radar detector one is a beaut. If some one from another State where Radar detectors are not illegal (WA for instance) were to take down his/her detector and secure it with in a box within a box in the boot or trailer. They would be in violation, tho how any one would know to search for it in the first place I dint know.

There was a case a couple of years back, where a bloke bought a truck from WA, had it parked out the front of his house and came out when he noticed a Policeman looking it over. He asked  the cop what he was doing, and got the reply that a radar detector had been picked up by his speed radar.
They eventually found it tucked up under the dash, so somehow or other, the cops' machine can pick up that vehicles have them whether or not they're in use or turned off.

A detector when powered up can be detected by listening for one of the mixer rf frequencies (very simplified explanation). You will some times get a false radar signal in your detector when passing a vehicle with a similar machune in it, detector detectors use the same principal. Its impossible to detect a powered off  detector, as it doesnt radiate any rf. The truck probably had a Fox or similar brand concealable unit that was always powered up (even with ignition off)

In years gone by - the motorists' association argued that they were nothing more than a passive receiver of a broadcast signal.

Dunno if this helped anyone.

Did you also know that in Qld - it is illegal to 'toot' your horn when bidding farewell to your friends as you leave their house!

These appear  to confuse Qld drivers.

Not only QLD drivers get confused.......not even SA gets the signs/lane markings right especially when overtaking lanes end. We have signs saying rule 149 applies but lane markings are are for rule 148.



Rule 148 applies for the LH diagram: (not an Aussie diagram but it was the closest I could find) Ending lane must give way to traffic in RH lane
Rule 149 applies for the RH diagram: Vehicle in front has right of way or words to that effect.

Correct oh stern ruler.  The horn is considered a warning device and therefore there is an offence for using an warning device

s224 Using horns and similar warning devices
A driver must not use, or allow to be used, a horn, or similar warning device, fitted to or in the driver’s vehicle unless—
(a) it is necessary to use the horn, or warning device, to warn other road users or animals of the approach or position of the vehicle; or
(b) the horn, or warning device, is being used as part of an anti-theft device, or an alcohol ignition interlock, fitted to the vehicle.
Maximum penalty—20 penalty units.  (Penalty Unit =$110)
